Compliance, What compliance? - a Varied View

ThisWeekinFM attended another of the highly successful events by CIBSE Facilities Management held in the City of London last week. The evening featured a range of discussions around compliance and associated awareness for building owners, occupiers, facilities managers and consultants.

The first presentation was by Rod Hunt, Partner at Clyde & Co who gave an engaging overview of the current and future Legislation affecting those involved in buildings. With particular focus on recommendations from Lofstedt report, CDM, RIDDOR and Fees For Intervention (FFI).

This was followed by a panel/audience discussion questioning whether Compliance is being achieved in practice.

Members of the panel were:

  • Greg Davies Head of Service Development, Assurity
  • Steve Hill – Director ENCRED
  • Kate McCormick – Green Economy Manager, Spie,

There were a number of interesting questions, answers and opinions raised during the lively debate, with key themes emerging:

  • There is a low take up for A/C inspections of building in practice
  • Three areas and difference of approach for overall compliance - Statutory H&S, Building Systems compliance and energy performance compliance
  • Owners/occupiers may well be informed but in practice are often only managing cost and risk of non-compliance (and penalties)
  • Reduction of technical ‘intelligent client function’ in organisations could be an influence
  • Compliance is strong where linked to insurance. E.g. Lifts, Fire, etc
  • Health & Safety compliance is taken seriously in organisations
  • There should be more drivers to support energy and other building related compliance - not just tick box approach, possibly linked to building insurance and naming non-compliant buildings and organisations
  • Wider aspects of compliance important for organisations demonstrating their CSR

 

What Happens when it Happens

The final session was from Chris Morrison, partner Clyde & Co who presented a mind focussing walkthrough entitled ‘What Happens when it Happens’, taking the audience through the life-cycle of in incident - particularly the role of the HSE and Police. Morrison considered all of the activities leading up to and including a prosecution. Questions and discussions followed.

The evening progressed through to a networking session.
